Aged 18 and over: AUD $2,385

Child under 18: AUD $1,190

Nomination Fee: Sponsors will generally need to pay an application fee of AUD $540

Not everyone is eligible, or will meet the 186 Visa conditions. To apply, you must meet the following minimum Visa 186 requirements:

·       Have been nominated by an Australian employer

·       Fall under the 186 Visa age limit, which 50 years old in most cases

·       Meet the skills, qualifications, and level of English proficiency

Health requirements

You must meet certain health requirements and have a health examination in one of the clinics recognised by the Australian Government. This applies to you and any members of your family unit included in your application. You are able to organise your health examinations upfront before lodging a visa application.

Character requirements

You must be prepared to provide a police certificate from each country you have lived in for 12 months or more during the past ten years and after turning the age of 16.

Debts with the Australian Government

You must not have any outstanding debts to the Australian Government or must arrange to repay any outstanding debts before the visa can be granted.

 

186 Visa Employer Checklist

Employers must meet all the requirements before nominating a skilled worker for permanent residence in Australia. The process consists of three main steps: nomination eligibility, nomination application, and visa application.

Eligibility

✔ Your business is actively and lawfully operating in Australia

 ✔ You have a genuine need for a skilled worker to fill a full-time position for at least two years

✔ The salary must be at least $70,000 per year (excluding superannuation) or meet the annual market salary rate (AMSR)

 ✔ The nominee’s terms and conditions must be comparable to Australian employees in similar roles

 ✔ The occupation is on the Medium and Long-term Strategic Skills List (MLTSSL) (unless applying via the Labour Agreement stream)

Choosing the correct stream

✔ Temporary Residence Transition (TRT) Stream – for employees who have worked for you on a 482 or 457 visa for at least three years

 ✔ Direct Entry (DE) Stream – for employees not previously working with you on a 482/457 visa but have skills and experience in the nominated occupation

 ✔ Labour Agreement Stream – for employers with a negotiated labour agreement with the Australian Government

Proving Labour Market Testing (LMT)

✔ If required, provide evidence that you have tried to hire an Australian worker before nominating a foreign worker. Job advertisements must have run for at least four weeks within the past four months

Preparing required documents for nomination

✔ Business registration documents (ABN, ACN, ASIC details)

 ✔ Organisational structure showing business operations

 ✔ Financial documents (BAS, tax records, profit/loss statements)

 ✔ Employment contract for the nominee, aligned with Australian labour laws

 ✔ Market Salary Report to prove the salary meets AMSR

 ✔ Training contribution (Skilling Australians Fund levy) payment receipt

Lodging the nomination application

✔ Submit the nomination application through ImmiAccount

 ✔ Pay the Skilling Australians Fund (SAF) levy (amount depends on business size)

Ensuring the employee meets visa criteria

✔ Employee has the necessary qualifications and work experience

 ✔ Employee meets English language requirements (unless exempt)
